​​​Exploring the regulatory landscape of health supplements and natural products in Malaysia

​The landscape of health supplements and natural products in Malaysia has witnessed notable shifts in recent years. From 2018 to 2022, the country saw the registration of 600 to 700 natural products annually, with a slight decline post-2020. Health supplements, meanwhile, averaged 300 to 400 registrations each year. Interestingly, the year 2020 marked a significant surge in natural product registrations, largely attributed to the COVID-19 pandemic. Daniel Ho (pix), from the Complementary and Alternative Medicine Section Centre for Products and Cosmetics Evaluation, National Pharmaceutical Regulatory Agency (NPRA), Ministry of Health Malaysia, highlighted these trends at the 5th International Integrative Medicine Conference 2024. The conference, themed "Healthspan - The Science and Art of Wellbeing," was organized by the Association of Integrative Medicine Malaysia (AIMM).

Understanding NPRA's role and regulatory framework
The NPRA serves as the secretariat to the Drug Control Authority (DCA), which operates under the Control of Drugs and Cosmetics Regulation (CDCR) 1984, promulgated under the Sale of Drugs Act 1952. The agency's primary role is to ensure the safety, quality, and efficacy of pharmaceuticals and health products in Malaysia.

Product registration: Necessity and exceptions
Not all products require registration. For instance, food items like fish and salmon sold in supermarkets fall under the jurisdiction of the Food Safety and Quality Division of the Ministry of Health and do not need NPRA registration. However, health supplements such as fish oil in soft gel form must be registered. Products like fish oil in jelly, gummy, or powder form might fall under the Food-Drug Interface (FDI) category, necessitating careful classification to determine appropriate regulatory oversight.

The Food-Drug Interface (FDI)
The FDI category encompasses products combining food ingredients and active ingredients for oral consumption. These products, which blur the lines between food and drugs, include items containing fruits, vegetables, meat, poultry, milk, cocoa, cereals, vitamins, minerals, herbs, enzymes, probiotics, prebiotics, amino acids, and peptides. They come in various forms such as powders, liquids, gels, chewable tablets, drops, or granules. Determining whether these products should be regulated as drugs (under NPRA) or as food (under the Food Safety and Quality Program) is crucial.

The product registration process
Once a product is determined to require registration, the application process begins with the submission of a product application form to NPRA. The evaluation process involves two types: full evaluation and abridged evaluation. Natural products and health supplements undergo abridged evaluation, where the efficacy is not assessed. Upon concluding the evaluation, NPRA discusses the outcome among product meeting members before proposing it to the DCA for final approval. Approved products receive a registration number, with health supplements marked by an "N" suffix and natural products by a "T" suffix.

Criteria for registration
Ingredients: Products must detail their active ingredients (beneficial components) and excipients (formulation aids).

Manufacturer: Products must be manufactured by a GMP-certified facility, with inspections conducted by NPRA for local manufacturers and certificates required for overseas manufacturers.

Product information: Essential details include product name, indications, dosage, warnings, storage conditions, and shelf life. Documentation supporting safety and quality, such as research papers and certificates of analysis, must be provided.

Health claims: Products must include health claims to inform consumers about their benefits. These claims fall into three categories: general claims (e.g., "for strengthening the body"), functional claims (e.g., "Vitamin A supports skin health"), and disease risk reduction claims. Functional claims require substantial evidence, such as human studies or ingredient monographs.

Post-registration and compliance
Registered products undergo post-registration variations for changes in product name, label design, manufacturing site, and more. NPRA's Post-Marketing Surveillance Department ensures compliance by scrutinizing labels and testing products for active components and contaminants. Registration is valid for five years, after which renewal is required, involving basic minimum requirements.

Trends and future directions
Daniel Ho's insights underscore the evolving nature of the health supplements and natural products sector in Malaysia. The initial spike in 2020 registrations reflects the increased public interest in health and wellness during the COVID-19 pandemic. Although the numbers have stabilized, the sector continues to grow, driven by consumer demand for natural health solutions.

The stringent regulatory framework established by NPRA ensures that health supplements and natural products in Malaysia meet high standards of safety, quality, and efficacy. This robust system not only protects consumers but also promotes transparency and trust in the burgeoning natural health market.
